Passengers May Have Legal Rights After a Crash

Passengers injured in a car accident are often caught in the middle of a situation they did not cause. In many cases, a passenger may have the right to pursue a claim against the driver who caused the crash.

That driver may be the driver of the vehicle the passenger was riding in, another driver, or more than one driver.

Passenger claims can involve multiple insurance policies. Depending on the facts, coverage may come from the at-fault driver’s insurance, the vehicle owner’s insurance, or other available policies.

It is important for injured passengers to document the crash carefully. This may include saving photos, getting witness information, keeping medical records, and requesting the police report.

Passengers should also avoid assuming that they cannot bring a claim because they know or are related to the driver. Injury claims are usually handled through insurance, not directly against someone’s personal finances in most routine cases.

Medical treatment is especially important. Some injuries, including concussions, soft tissue injuries, and back injuries, may not fully appear until hours or days later.
