What is a Wrongful Death Claim?

What’s called a “wrongful death claim” may arise when a person dies as a result of another party’s negligence or wrongful conduct. These claims are filed on behalf of surviving family members.


Wrongful death claims often stem from car accidents, medical malpractice, workplace accidents, defective products, and dangerous property conditions.

In Pennsylvania, a wrongful death action may be brought by the spouse, children, or parents of the deceased individual. If none exist, the personal representative of the estate may bring the claim.


Damages in a wrongful death case may include funeral and burial expenses, loss of income, loss of companionship, and emotional suffering of surviving family members.


Pennsylvania generally requires that a wrongful death lawsuit be filed within two years of the date of death.
