What You Need to Know After a Car Accident in Pennsylvania

A car accident can leave people shaken, confused, and not sure about what to do next. In Pennsylvania, there are some specific steps accident victims should take to protect their health, to document the incident, and to preserve their legal rights.


The first priority should be safety. If you are able, move your vehicle out of traffic and turn on your hazard lights. Check yourself and others for injuries. Even if injuries appear minor, they should be taken seriously, because some symptoms may not show up immediately.


Calling 911 is an important step. When police officers respond to the scene, they’ll create an accident report, which can later become important documentation. Emergency medical personnel can also examine those involved and provide treatment at the scene, or transport them to a hospital if needed.


In Pennsylvania, it is important to exchange information with the other driver or drivers involved. This includes names, addresses, phone numbers, license plate numbers, driver’s license numbers, and insurance information. If there are any witnesses, their contact information should also be collected.


Photographs and videos can make a major difference later. Accident victims should take pictures of vehicle damage, skid marks, traffic signals, road conditions, weather conditions, and visible injuries. These images can help establish what happened and who may be responsible.


Pennsylvania follows what’s called a “choice no-fault” auto insurance system. This means that when you purchase auto insurance, you choose either a limited tort or full tort option. Limited tort generally restricts your ability to recover damages for pain and suffering, though there are some exceptions. Full tort preserves your right to seek compensation for all damages, including pain and suffering, regardless of the severity of your injury.


Even if you believe the accident was minor, it is important to get medical attention as soon as possible. Any delays in treatment can raise questions later, and may result in undiagnosed injuries getting worse.


Report the accident to your insurance company as soon as reasonably possible. Be factual, but do not speculate about fault or downplay injuries. Insurance adjusters may use statements to limit what they pay.


Car accidents in Pennsylvania can involve complicated questions of fault, medical expenses, insurance coverage, lost wages, and long-term impact. Documenting everything and understanding your rights under state law is essential to protect yourself following a crash.
